Terms of Use

Please read these Terms of Use ("Terms") carefully before using the DishPassport mobile application ("App") operated by DishPassport ("we," "us," or "our"). By accessing or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use DishPassport. By using the App, you represent that you meet this requirement. If you are between 13 and 18, a parent or legal guardian must have reviewed and agreed to these Terms on your behalf.

2. Description of the App

DishPassport is a mobile application that uses AI technology to scan, translate, and describe restaurant menus. Features include dish translation, allergen flagging, approximate calorie estimates, currency conversion, and pronunciation assistance. The App is provided for personal, non-commercial use.

3. App Provided "As Is"

DishPassport is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the App will be error-free, uninterrupted, or free of harmful components.

We reserve the right to modify, suspend, or discontinue any aspect of the App at any time without notice or liability.

4. AI Outputs Are Approximate — Not Medical Advice

DishPassport uses artificial intelligence to translate menus and estimate nutritional content, allergen information, and dish descriptions. These outputs are approximations only. Translations may be inaccurate. Allergen alerts may be incomplete or incorrect. Calorie and nutrition estimates are AI-generated and have not been verified by a dietitian or medical professional.

Nothing in this App constitutes medical, dietary, or nutritional advice. If you have a food allergy, intolerance, or medical condition, always verify dish ingredients directly with restaurant staff before ordering. Do not rely solely on DishPassport for allergy-related decisions.

5. Subscription Terms

5.1 Free Tier

DishPassport offers a free tier that includes a limited number of menu scans and basic features. No payment is required for the free tier.

5.2 DishPassport Pro

DishPassport Pro is a paid subscription that unlocks unlimited scans, all languages, allergen alerts, pronunciation audio, recipes, currency conversion, dietary filters, offline caching, and calorie estimates.

5.3 Billing and Auto-Renewal

Subscriptions are available monthly ($6.99/month) or annually ($49.99/year). Payment is charged to your App Store or Google Play account at purchase confirmation. Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current billing period.

5.4 Managing Your Subscription

Manage and cancel your subscription through your Apple App Store or Google Play account settings. Cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods except where required by applicable law.

5.5 Price Changes

We reserve the right to change subscription pricing. You will be notified of changes before they take effect on your account.

6. Permitted Use

You agree not to:

• Reverse engineer, decompile, or disassemble the App
• Use the App to transmit any illegal, harmful, or offensive content
• Attempt to gain unauthorized access to any part of the App or its systems
• Use automated tools or bots to access the App
• Resell, sublicense, or redistribute the App or its content
• Use the App for any commercial purpose without our prior written consent

7. Intellectual Property

All content, design, graphics, trademarks, logos, and software in DishPassport are the exclusive intellectual property of DishPassport or its licensors. Nothing in these Terms grants you any right beyond the limited license to use the App as described herein. The "DishPassport" name and logo are trademarks of DishPassport. Unauthorized use is prohibited.

8. Third-Party Services

The App integrates with OpenAI, RevenueCat, Supabase, Apple App Store, and Google Play Store. Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices, content, or reliability of any third-party service.

9. Limitation of Liability

To the maximum extent permitted by applicable law, DishPassport and its officers, employees, agents, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of — or inability to use — the App, including damages from reliance on any translation, allergen alert, or nutritional estimate.

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim (or $10 if you used only the free tier).

10. Indemnification

You agree to indemnify and hold harmless DishPassport and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses arising from your use of the App or violation of these Terms.

11. Governing Law

These Terms are governed by the laws of the State of Florida, United States, without regard to conflict of law provisions. Disputes shall be resolved in state or federal courts in Florida.

12. Changes to These Terms

We may update these Terms at any time. We will update the "Last updated" date above. Continued use of the App after changes are posted constitutes acceptance of the revised Terms.
